They serve as the foundation for everything from marriage vows to international treaties, embodying our capacity to create binding commitments that shape the future.
Against this background, Hal Varian's "uncontract" reveals its destructiveness-abandoning legally binding human promises for automated machine processes. These uncontracts, exemplified by smart devices and algorithmic systems, replace human judgment with automated enforcement mechanisms. Unlike traditional tyranny, it doesn't require whips, camps, or gulags-only reassuring messages, emoticons, gentle voices answering queries, TVs that hear you, houses that know you, beds that welcome whispers, and books that read you. Big Other replaces legitimate contract, rule of law, politics, and social trust with a privately administered regime of reinforcements.
Instrumentarian power has gathered strength outside both mankind and democracy. Democratic societies remain vulnerable to unprecedented power. Surveillance capitalism emerges amid a global "democratic recession" with weakening attachment to democracy-only 40% of US respondents support democracy while rejecting alternatives.
