    Justice ou acharnement : le dilemme nazi

    Lena : Dis, Miles, je suis tombée sur un entrefilet l'autre jour : la justice allemande enquête encore sur un ancien gardien de camp nazi qui a fêté ses 100 ans. Ça m'a fait bugger. Je veux dire, le mec est centenaire, il est probablement au bout du rouleau... Est-ce que ça a encore un sens de traîner des gens dans cet état devant un tribunal, quatre-vingts ans après les faits ?

    Miles : Bah, c'est tout le dilemme. D'un côté, tu as ce principe né à Nuremberg en 1945 qui dit que l'impunité des chefs d'État et des exécutants doit cesser, peu importe le temps qui passe. Mais de l'autre, on se retrouve face à des situations presque absurdes où l'accusé simule la folie, comme on l'avait vu au procès de Tokyo, ou perd son pantalon à l'audience parce qu'il est trop affaibli.

    Lena : Justement, c'est là que je m'interroge. Entre la mémoire qui flanche et la déchéance physique, la fonction de la peine, elle devient quoi ? On ne va pas mettre un centenaire en cellule, si ?

    Miles : Pas faux. Il y a une vraie tension entre l'exigence de justice pour les victimes et l'éthique du traitement des personnes âgées. En fait, certains se demandent si on n'est pas passé de la justice à une forme de vengeance tardive, surtout quand on sait que l'Allemagne a mis des décennies à "nettoyer ses écuries" et que beaucoup d'anciens nazis ont été réintégrés tranquillement après-guerre.

    Lena : C'est ça le truc. Si on a attendu 2026 pour s'en occuper, est-ce que ce n'est pas un peu hypocrite ? Pour comprendre pourquoi on s'acharne ou pourquoi on devrait s'arrêter, faut qu'on regarde ce que le droit dit vraiment sur cette absence de prescription...
