Significantly, he grouped the right to keep and bear arms with individual rights like freedom of speech, placing it after Article I, Section 9's individual protections - not with militia powers in Article I, Section 8. This placement reveals Madison viewed arms rights as individual liberties rather than primarily militia-related restrictions. Madison's personal notes suggest he viewed the English Declaration of Rights as inadequate protection for individual liberties. His notes specifically mention "Arms to protests" (referring to the Declaration's limitation of arms rights to Protestants), indicating he intended the American Bill of Rights to protect individual arms ownership without religious restrictions. The Committee of Eleven, reviewing Madison's proposals, generally reduced his language but maintained the substance of the arms provision, reversing the order of clauses to place "A well-regulated militia" before "the right of the people to keep and bear arms shall not be infringed," while retaining the conscientious objector clause. House debate on the arms provision focused almost exclusively on the conscientious objector clause, with virtually no controversy over the right to keep and bear arms itself. Elbridge Gerry worried the conscientious objector provision might be abused to disarm citizens and undermine the militia. After limited debate, the House approved the provision with the militia and arms rights clauses intact. Though Senate debates weren't recorded, their journal shows they rejected an amendment that would have limited arms rights "for the common defense" - a restriction previously contested during Massachusetts' bill of rights drafting. The Senate also defeated a provision stating standing armies should be avoided, suggesting that while army concerns influenced the amendment, they weren't its core purpose. Tench Coxe, a prominent federalist writer and personal friend of Madison, published an article in the Federal Gazette shortly after Madison introduced his bill. In this uniquely authoritative contemporary explanation, Coxe wrote that "As civil rulers... may attempt to tyrannize, and as the military forces... might pervert their power to the injury of their fellow-citizens, the people are confirmed by the next article in their right to keep and bear their private arms." Madison expressed appreciation for these "explanatory strictures of a healing tendency." The lack of extensive debate over the right to keep and bear arms suggests it wasn't controversial-unlike many other provisions that generated significant discussion. Both Federalists and Anti-federalists agreed on the importance of an armed citizenry; they simply disagreed on whether this required explicit constitutional protection.

From Founding to Modern Era: Evolving Interpretations

Early judicial interpretations of the right to keep and bear arms came almost exclusively from state courts, simply because there were no federal arms laws to challenge. State courts developed differing views on the nature and limits of the right to bear arms. In 1822, Kentucky's highest court voided the state's 1813 ban on carrying concealed weapons, ruling that any constraint on "the full and complete exercise of that right" was "forbidden by the explicit language of the constitution." Louisiana's Court of Appeals, however, upheld a concealed weapons ban, reasoning that it "interferes with no man's right to carry arms 'in full open view,'" which the court recognized as "a right guaranteed by the Constitution of the United States." When upholding a concealed carrying ban in 1840, the Alabama Supreme Court issued a warning that regulation has limits. While acknowledging the legislature's right to regulate "the manner in which arms shall be borne," the court emphasized that "a statute which, under the pretence of regulating, amounts to a destruction of the right, or which requires arms to be so borne as to render them wholly useless for the purpose of defense, would be clearly unconstitutional." Georgia enacted a statute banning all private possession of certain weapons, including pistols, on December 25, 1837. Despite Georgia having no right to bear arms in its state constitution, the Supreme Court in Nunn v. State struck down the law as violative of the Second Amendment. The court held that the right to keep and bear arms belonged to "whole people, old and young, men, women and boys," not just militia, and that this right "shall not be infringed...in the slightest degree." In the infamous Dred Scott decision, Chief Justice Taney argued that the Constitution's framers couldn't have considered free blacks as citizens because citizenship would give them rights including "the full liberty of speech" and "to keep and carry arms wherever they went." Though meant to uphold slavery, the opinion inadvertently confirmed the individual nature of the right to bear arms as understood at that time. In U.S. v. Miller (1939), concerning the National Firearms Act's regulation of sawed-off shotguns, the Supreme Court remanded for evidence on whether such weapons had "some reasonable relationship to the preservation or efficiency of a well-regulated militia." The Court noted that the militia "comprised all males physically capable of acting in concert for the common defense" who were "expected to appear bearing arms supplied by themselves and of the kind in common use at the time." After sixty years of silence on the Second Amendment, the Supreme Court ruled in District of Columbia v. Heller (2008) on a challenge to D.C.'s handgun ban. Justice Scalia wrote for the 5-4 majority, dividing the amendment into prefatory and operative clauses. He concluded that "the right of the people" refers to an individual right, not a collective one, and that "keep and bear Arms" means possessing and carrying weapons for confrontation. The Court traced the right's origins to English history and held that while the amendment's purpose was preventing elimination of the militia, Americans also valued the right for self-defense and hunting. In McDonald v. Chicago (2010), the Supreme Court ruled 5-4 that the Second Amendment applies to state governments through the Fourteenth Amendment's Due Process Clause. The Court's opinion emphasized that the right to keep and bear arms is "fundamental to our scheme of ordered liberty" and "deeply rooted in this Nation's history and tradition." The majority detailed post-Civil War evidence showing Congress explicitly intended to protect freedmen's right to arms, including the Freedmen's Bureau Act of 1866 which secured "the constitutional right to bear arms" regardless of race. The Second Amendment's journey from ancient Saxon duty to constitutional right to modern controversy reflects America's complex relationship with arms and liberty. What began as a communal obligation evolved into an individual right, one that has been continuously reinterpreted through changing historical circumstances. Yet through all these changes, the core concept-that an armed citizenry provides a check against tyranny and a means of self-defense-has remained remarkably consistent across nearly a millennium of Anglo-American legal tradition.
