This approach deliberately limits its constitutional scope to avoid perverse incentives like those experienced in Germany, while still ensuring fundamental fairness. While these three rights should be constitutionally protected, other refugee entitlements-like welfare and employment rights-should exist at the ordinary law level. This provides necessary flexibility during mass influxes while still maintaining core protections. Critics like Daniel Stoffman argue that Canada's Singh-based refugee policy compromises sovereignty without truly helping refugees. Stoffman contrasts Canada's high in-country acceptance rate with Norway's approach of rejecting most domestic claimants while generously funding overseas refugee camps. He suggests Canada should screen out "transparently fraudulent" claims at the border and redirect resources to "real refugees" in camps. However, Stoffman's statistics are misleading and his arguments flawed. His sharp distinction between "fraudulent" asylum-seekers and "legitimate" overseas refugees is false. In both domestic asylum systems and overseas camps, careful judgment is required to ensure genuine refugees benefit. An open refugee system inevitably faces political costs when controversial individuals access it. In 2003, Holocaust denier Ernst Zundel filed a refugee claim in Canada to avoid deportation to Germany on hate crime charges. Many observers were outraged that someone who published works like "The Hitler We Loved and Why" could use a system designed to protect those fleeing persecution. The Zundel case forces us to confront where the boundaries of an open refugee system should lie. While refugee law has always excluded violent individuals like war criminals, Zundel represented a different challenge-someone with repellent views but no history of violence. Canada's participation in interdiction measures undermines the Singh decision's principles. Howard Adelman of York University notes that "Canada probably has one of the best systems of interdiction at airports abroad," where officials use clever questioning about phone numbers and addresses to catch travelers with false documents before they can board planes to Canada. Had such measures existed when Francine Peyti fled Zaire in 1997 on a fake Dutch passport, she would have been prevented from reaching safety in Canada despite facing violence at home. Since Singh's protections only apply to those who reach Canadian soil, interdiction at airports and sea effectively circumvents these rights, confirming Hannah Arendt's critique that human rights remain most tenuous on the high seas.

The Legend of Ahmed Ressam: Myths and Realities of Refugee Security

Peter Showler, head of Canada's Immigration and Refugee Board, was in his Ottawa office on September 11, 2001, when they watched the World Trade Center attacks unfold. In the aftermath, media speculation quickly turned to Canada's border security. By September 13, newspapers were claiming terrorists had entered the U.S. through Canada, despite no evidence linking the 9/11 attackers to the country. As investigators cleared Canada's connection to 9/11, attention focused on Ahmed Ressam, the "Millennium Bomber" who had previously exploited Canada's refugee system before his failed plot to bomb Los Angeles Airport in 1999. Born in 1967 in Algeria, Ressam was initially non-religious, spending his youth "drinking wine, smoking hash and hitting on women." When Algeria's democratic experiment collapsed into civil war in the early 1990s, he fled to France, later entering Montreal in 1994 with a fake French passport to join the Algerian expatriate community. Upon arrival, customs immediately detected his forged passport. Ressam then filed a fabricated refugee claim, missing both his hearing and abandonment hearing. Though scheduled for deportation after his claim's rejection in 1996, officials considered his case low priority. Through Montreal's Assuna Annabawiyah mosque, Ressam connected with extremist figures who offered him purpose. He obtained a Canadian passport under the false name "Benni Norris" using a forged baptismal certificate, enabling him to travel to Afghanistan for al-Qaeda training in 1998, despite being on a CSIS watch list. After Ressam's arrest, politicians weaponized his case to advocate for immigration restrictions, often misrepresenting facts. Showler attempted to correct the record, noting that no 9/11 attackers had entered through any refugee system, whether Canadian or American. Contrary to popular narrative, Canada's refugee system may serve as an effective security tool. A review of twenty-six asylum claims by individuals with extremist connections between 1988-2001 showed none successfully executed attacks. Most were either arrested, surveilled, or deported, suggesting that attempting to enter through the refugee system actually increases terrorists' chances of detection.

In the Tracks of Leviathan: Sovereignty's Evolution and Refugee Rights

This chapter addresses Hannah Arendt's diagnosis of the conflict between human rights and national sovereignty. While the author has proposed solutions to enforce refugee rights in a world of sovereign states, these solutions aren't currently law anywhere, and the tension Arendt identified persists. This might lead some to conclude the problem is unsolvable-that sovereignty is an immovable force against which human rights will always struggle ineffectively. Though sovereign states seem like permanent fixtures, they're actually human-created institutions that arose at particular times and places, evolving in response to changing needs. Understanding sovereignty's historical development reveals that states may eventually exercise their power with greater respect for human rights than is currently typical. Sovereignty can be understood in two distinct ways: as a property of states (legal authority within borders) or as a property of peoples (self-determination in matters like elections or immigration). These can conflict, as when populations seek to participate in elections forbidden by undemocratic governments. Arendt's critique primarily addresses state sovereignty, but popular sovereignty presents an even more acute challenge. In a hypothetical pre-state scenario of people in a boat deciding whether to rescue someone in the water, no internal rule can force a universally unwilling group to admit an outsider. John Toul's thirteenth-century oath to four different lords illustrates political organization before sovereign states. His elaborate pledge detailing obligations when his masters went to war with each other reveals a world fundamentally different from our modern understanding of sovereignty-one where political power wasn't allocated along territorial lines and where multiple authorities could claim legitimacy in the same space. Medieval political power operated without mutually recognized territorial borders. Authority was based on clan membership or military power rather than fixed geography. Political hierarchies were fragmented and shifting, with complex networks of personal ties between vassals, lords and kings. Adding to this complexity were institutions like the church and Holy Roman Empire that made universal claims to authority. The rise of sovereign states wasn't inevitable. Other forms of political organization emerged alongside them, notably city states in Italy and city leagues around the North and Baltic seas. The powerful Hanseatic League eventually included almost two hundred towns, controlling Baltic and North Sea trade and wielding enough power to depose foreign kings. These leagues signed treaties, collected revenues, raised armies and regulated social life, but lacked both a single supreme authority and defined borders. Sovereign states ultimately displaced alternative forms of government for two key reasons. First, they provided superior internal organization through standardization of currencies, laws, and measurements. Second, sovereign states found it easiest to conduct foreign relations with other sovereign states. The year 1648 marked a crucial turning point when European diplomats signed the Peace of Westphalia, ending the devastating Thirty Years War. Though England, France and Sweden already functioned as sovereign states, Westphalia's significance lay in states formally recognizing each other as equals, effectively ending religious interference between Catholic and Protestant rulers. Before the nineteenth century, no "refugee crises" existed as we understand them today. Though people fled religious persecution and war, most lacked means to travel far or sustain themselves. The modern border regime emerged between the 1880s and 1920s, driven largely by nationalism. As shared language and ethnicity became defining characteristics of national identity, governments needed to distinguish citizens from non-citizens, especially as welfare states developed. The distinction between "national" and "foreigner" sharpened dramatically. Sovereignty has three distinct dimensions that emerged at different historical moments. "Domestic sovereignty"-control over internal territory-arose first in Western Europe as a solution to the inefficiencies of localism. "International legal sovereignty"-formal recognition between states-emerged with the Peace of Westphalia to end religious warfare. "Interdependence sovereignty"-border control-appeared last, in the early twentieth century, as a response to mass migration. The conflict between sovereignty and human rights isn't new-and sometimes human rights win. The abolition of the transatlantic slave trade offers a powerful historical precedent. After Britain outlawed slave transportation on its vessels in 1807, most European countries followed. When Portugal and Brazil resisted, Britain took extraordinary measures, unilaterally authorizing its navy to seize Portuguese slave ships in 1839 and later sending warships into Brazilian waters to burn slave vessels. These examples reveal sovereignty's curious nature as "organized hypocrisy"-the principle of non-intervention is constantly affirmed yet routinely violated. While sovereignty violations have often served imperial interests, they have also advanced genuine human rights. This continues today with calls for states to acknowledge a "responsibility to protect" in debates about genocide intervention, making state authority conditional upon upholding rights.
