The Second Founding refers to the critical re-evaluation of the U.S. Constitution regarding race and citizenship. While the original 1788 document used inclusive language like 'We the People,' the reality for African Americans was far different. This period addresses the broken relationship between the founding documents and the population, seeking to fix the framework that initially baked inequality into the American project's foundation.
The Three-Fifths Compromise, found in Article I of the Constitution, is a primary example of early constitutional inequality. It dictated that enslaved people were counted as three-fifths of a person solely to increase the population numbers of states for Congressional seating. This meant African Americans were used to boost the political power of those enslaving them while being denied the rights and status of actual citizens.
When the U.S. Constitution was ratified in 1788, it did not explicitly restrict citizenship based on race on paper. However, as discussed in The Constitution’s Second Founding, the mechanics of the document told a different story. Through compromises and specific frameworks like Article I, the document created a paradox where African Americans were part of the country's math for power but excluded from the promise of its people.
