However, foreigners and foreign-owned companies are strictly prohibited from owning agricultural land. If a foreigner inherits agricultural land, they are legally required to dispose of it within one calendar year. Additionally, land in "border zones" or near military facilities is highly restricted for foreign ownership.
Using a Ukrainian Limited Liability Company (LLC) provides significant advantages regarding residency, liability, and future exit strategies. While buying property as an individual is possible, an LLC allows an investor to qualify for permanent residency by classifying the purchase as a "foreign direct investment." Furthermore, an LLC structure offers a cleaner "exit" because an investor can sell the corporate rights of the company rather than the physical property, which is often faster and separates personal assets from investment risks.
In the current market, traditional amenities like views or high floors have been deprioritized in favor of safety and autonomy. The most liquid and valuable assets are "autonomous" buildings equipped with backup generators, satellite internet, and certified underground shelters or bunkers. Properties on lower floors (third or fourth) are currently more desirable than penthouses because they remain accessible during power outages and provide quicker access to stairwells and shelters.
Repatriation of funds depends entirely on how the investment was documented at the start. To move profits or sale proceeds back to the US, the investment must be registered as a "Foreign Direct Investment" through a Ukrainian bank, with funds arriving from abroad in a convertible currency. Following these National Bank of Ukraine (NBU) "lanes" ensures that the investor has the legal right to convert hryvnia back into dollars and wire the money out once local taxes, such as the military levy, are paid.
The primary bottleneck is the Anti-Money Laundering (AML) and "Source of Funds" verification process. Ukrainian banks, under pressure to prevent sanctions evasion, require a bulletproof trail of documentation—including tax returns and salary statements—showing the entire path of the capital. If an investor cannot prove the legal origin of their funds to the satisfaction of both local and international compliance officers, the bank will block the transaction, regardless of the property's status.
