¿Cuál es la diferencia entre un acto nulo de pleno derecho y uno anulable?

La nulidad de pleno derecho es la irregularidad más grave y afecta a actos que nacen "muertos" por vicios insubsanables, como la lesión de derechos fundamentales o ser dictados por órganos manifiestamente incompetentes; estos actos no pueden convalidarse. Por el contrario, los actos anulables presentan defectos menores o infracciones del ordenamiento que pueden ser "curados" o convalidados por la Administración para permitir que el procedimiento continúe, bajo el principio de conservación del acto.

¿Cómo se deben computar los plazos por días según la Ley 39/2015?

La regla general establece que los plazos comienzan a contar a partir del día siguiente al de la notificación. Si el plazo se señala por días, se entiende que son días hábiles, lo que significa que se deben excluir de la cuenta los sábados, los domingos y los días declarados festivos. Solo en el caso de que una ley o el derecho de la Unión Europea indiquen expresamente que los días son "naturales" se computarían todos los días del calendario sin excepciones.

¿Qué sucede si la Administración no resuelve un procedimiento en el plazo establecido?

Cuando la Administración no contesta de forma expresa, se produce el fenómeno del silencio administrativo. En procedimientos iniciados a solicitud del interesado, la regla general es el silencio positivo (se entiende estimada la petición), aunque existen excepciones importantes donde el silencio es negativo, como en casos que afecten al medio ambiente, servicios públicos, reclamaciones de responsabilidad patrimonial o en la resolución de recursos administrativos.

¿Quiénes están obligados a relacionarse con la Administración exclusivamente por medios electrónicos?

Según el artículo 14 de la ley, existe un colectivo obligado a la vía digital que incluye a las personas jurídicas (empresas), entidades sin personalidad jurídica (como comunidades de vecinos) y profesionales que requieran colegiación obligatoria para sus trámites. Si estos sujetos presentan documentos en papel, la Administración les requerirá para que subsanen el error a través de la vía electrónica, considerándose como fecha de presentación aquella en la que se realice la subsanación digital.

¿En qué se diferencian los recursos de alzada y de reposición?

El recurso de alzada se interpone ante el superior jerárquico del órgano que dictó el acto y es un paso obligatorio si se desea acudir posteriormente a la vía judicial. El recurso de reposición es potestativo u opcional, se dirige al mismo órgano que dictó la resolución y se utiliza contra actos que ya ponen fin a la vía administrativa. En ambos casos, el plazo para interponerlos es de un mes si el acto es expreso.
