    Una deuda ganancial es aquella contraída durante el matrimonio con el objetivo de beneficiar a la familia o sostener las cargas del hogar, como la reforma de la vivienda familiar o gastos de alimentación. Por el contrario, una deuda privativa es aquella que pertenece a un solo cónyuge, ya sea porque se contrajo antes del matrimonio o porque se utilizó para un beneficio puramente personal sin el consentimiento del otro. La ley presume que las deudas contraídas durante el matrimonio son gananciales, por lo que quien alegue que una deuda es privativa debe presentar pruebas, como extractos bancarios que demuestren gastos ajenos al interés familiar.

    El banco no es parte del proceso de divorcio ni de la sentencia judicial, por lo que los contratos firmados con la entidad financiera siguen vigentes bajo el principio de responsabilidad solidaria. Si ambos cónyuges firmaron como titulares de un préstamo, el banco tiene el derecho legal de reclamar el 100% de la deuda a cualquiera de los dos, independientemente de lo que diga el convenio regulador. Si uno de los ex cónyuges termina pagando la parte que le correspondía al otro según la sentencia, nace entonces un derecho de reembolso para reclamar internamente esa cantidad al otro titular.

    El derecho de reembolso, fundamentado en el artículo 1358 del Código Civil, establece que si un cónyuge paga una deuda ganancial con su propio dinero (dinero privativo), tiene derecho a que la sociedad de gananciales o el otro cónyuge le devuelva ese importe. En la práctica, esto significa que si uno de los dos asume el pago mensual de un crédito común tras la separación, debe documentar estos pagos claramente para que, al momento de liquidar los bienes, se le reconozca ese crédito a su favor y pueda recuperar el exceso pagado.

    Aunque ambos cónyuges suelen ser responsables al 50% de las deudas que mejoran la propiedad (como la construcción de una cerca), el hecho de que solo uno de ellos disfrute de la vivienda puede generar un desequilibrio financiero. La jurisprudencia permite plantear compensaciones si uno de los copropietarios asume todas las cargas mientras el otro utiliza el bien de forma exclusiva. En estos casos, se puede negociar que los pagos de la deuda se compensen con el valor del alquiler que el cónyuge que vive fuera está dejando de percibir por su mitad de la casa.

    Pagar deudas "de palabra" o mediante transferencias sin un concepto claro es altamente arriesgado, ya que legalmente podría interpretarse como una donación voluntaria o una pensión no reglada en lugar de un pago de deuda. Sin un inventario detallado de activos y pasivos visado por abogados, un cónyuge podría terminar pagando deudas que en realidad eran privativas del otro o incluso pagar dos veces si el acreedor original decide embargar su nómina por falta de pago directo al banco. La falta de liquidación formal mantiene un "cordón umbilical financiero" que puede afectar incluso a los herederos en caso de fallecimiento.
