Shelter as a Right: The Pavement Dwellers' Struggle
The Olga Tellis case marked a watershed moment when the Supreme Court expanded the meaning of fundamental rights to include socio-economic "second generation rights." While the Indian Constitution originally followed the conventional division between enforceable civil and political rights versus aspirational socio-economic rights, judicial activism in the 1970s and '80s began expanding Article 21's scope to encompass basic human needs.
Every year, hundreds of thousands of rural migrants flock to Mumbai seeking work, settling in informal settlements near their workplaces. In July 1981, Maharashtra Chief Minister A.R. Antulay announced that all Mumbai residents living in informal settlements or squatting on pavements without photo-passes would be forcibly evicted and either deported to their places of origin or relocated outside Mumbai. The Municipal Commissioner ordered the removal of these "encroachments" under Sections 312-14 of the Mumbai Municipal Corporation Act, which authorized removal without prior notice.
The Supreme Court's judgment opened with a stark, candid description of pavement dwellers' living conditions-existing amid filth and squalor, cooking and sleeping where they ease, with women bathing under the gaze of passersby. In this landmark decision, the Court affirmed for the first time that the right to life includes the right to livelihood. The Court reasoned that depriving someone of their means of livelihood would effectively deprive them of their right to life itself.
While recognizing that slum dwellers couldn't be evicted without affecting their livelihood, the Court nevertheless held that the procedure prescribed by the BMC Act was not unfair or unreasonable. The real victory lay in the BMC's undertakings during the case, signifying the state's acceptance that slum dwellers deserved alternative accommodation. Throughout the 1990s, Indian courts upheld these principles, asserting the state's constitutional obligation to provide housing to economically disadvantaged segments of society.
However, a symbolic shift occurred in the Supreme Court's approach to displacement in later years. In the Narmada Bachao Andolan case, the Court allowed construction of the Sardar Sarovar Dam to proceed despite the displacement of 320,000 people-the largest court-sanctioned forced eviction in the world. The Court's simplistic reasoning claimed that after rehabilitation, tribals would enjoy "better amenities than in their tribal hamlets," disregarding its own precedents emphasizing the right to shelter.
Even more troubling was the harsh language used in Almitra Patel v. Corporate Accountability: The Bhopal Gas Tragedy's Legal Legacy
In 1970, Union Carbide India Ltd (UCIL), majority-owned by American company Union Carbide Corporation (UCC), built a pesticide plant in densely populated Bhopal. On December 2-3, 1984, water seeped into a tank containing forty tonnes of methyl isocyanate, causing a catastrophic gas leak that transformed Bhopal into a "gas chamber." The immediate death toll reached 2,600, rising to 8,000 within two weeks, with estimates eventually reaching 20,000 deaths and 600,000 suffering irreparable damage.
Following the disaster, the Indian government quickly intervened by enacting the Bhopal Gas Leak Disaster Act, which gave the Central government exclusive right to represent victims under the "parens patriae" doctrine. This move drew criticism since UCIL was partly owned by state corporations, creating a conflict where the government represented victims who might have initiated action against it.
In April 1985, the Indian government filed a complaint against UCC in New York. Bizarrely, India argued its own courts were incompetent to handle the case, citing an ill-equipped legal system, endemic delays, lawyers lacking tort expertise, underdeveloped tort law, and procedural hindrances. Judge Keenan dismissed the case on forum non conveniens grounds, ruling that evidence and witnesses were primarily in India and that India had a superior interest in developing safety standards.
After returning to India, the government sued UCC in Bhopal district court. In February 1989, the Supreme Court ordered UCC to pay $470 million (approximately 750 crore rupees) as full settlement for all claims, concluding civil proceedings and quashing criminal charges. This settlement was a compromise between UCC's offer of $426 million and India's demand for $500 million. Victims were deeply dissatisfied, as the government had previously suggested compensation of $3 billion. The settlement meant each victim would receive less than 50,000 rupees-a stark reflection of how Indian law undervalues human life compared to other nations.
Following widespread condemnation, the Supreme Court reviewed the settlement. It upheld the amount but did revive criminal proceedings against UCC officers. After criminal proceedings resumed, the Supreme Court reduced the charges from culpable homicide (punishable by up to 10 years) to causing death by negligence (maximum 2 years). In June 2010, seven people were finally convicted and sentenced to the maximum two years imprisonment-a punishment widely criticized as treating the disaster like a "minor traffic accident."
The Bhopal disaster exemplified how multinational corporations exploit developing countries by importing hazardous technology into environments lacking adequate environmental laws and legal infrastructure. In stark contrast to Bhopal's handling, when the Gulf of Mexico oil spill occurred in 2010, BP created a $20 billion fund within weeks to address damages. One can't help but wonder: had the BP accident occurred in Indian waters, would the corporation have paid even half the compensation it eventually did?
The disaster finally jolted India's lackadaisical policymakers into action, leading to the Environment Protection Act (1986), the Public Liability Insurance Act, and Environmental Impact Assessment protocols. Despite raising environmental consciousness, significant gaps remain in India's legal framework. Balancing Merit and Opportunity: The Reservation System
India's reservation policy is an issue nearly every post-Independence Indian encounters-whether utilizing, criticizing, or suffering from it. These "affirmative action" measures provide percentage-based quotas favoring historically disadvantaged groups, primarily linked to India's caste system. With nearly half a billion Indians now eligible for preferential treatment, reservations have become increasingly contentious.
Reservations began with Maharaja Shahu IV of Kolhapur in 1902, aiming to eradicate poverty among backward classes and increase their participation in public administration. India's Constitution formalized this framework through various articles, though critics have called these provisions pro-Hindu since they primarily addressed the caste system, leaving disadvantaged Muslims unable to access many benefits.
The first clash between Parliament and courts occurred in 1951 when the Supreme Court struck down quota-based reservations in Madras colleges as contrary to Article 29(2). Parliament responded by amending Article 15 to allow special provisions for backward classes. In 1979, Prime Minister Morarji Desai established the second backward classes commission under B.P. Mandal to determine criteria for defining socially and educationally backward classes. The commission identified 3743 backward castes comprising approximately 52 percent of India's population. Since 22.5 percent reservation already existed for SC/ST candidates, the commission recommended 27 percent for OBCs to maintain the 50 percent ceiling.
After ten years of dormancy, Prime Minister V.P. Singh's 1990 implementation announcement triggered unprecedented violence, including over 100 self-immolations by protesting students. Journalist Indra Sawhney filed a PIL challenging the constitutional validity of these measures, which was clubbed with other petitions. The Supreme Court delivered a split decision with a 6:3 majority on most questions. Most significantly, the court ruled that the "creamy layer"-prosperous members of backward classes-should be excluded from reservations. Anyone with income above a certain limit or whose parents held important public positions couldn't access reservations, ensuring benefits reached the lowest rungs. The court found the 10 percent quota for economically backward persons unconstitutional, as reservations weren't meant to eradicate general poverty. Though the Mandal controversy gradually subsided, the UPA government reignited it in 2006 by extending the commission's recommendations to reserve 27 percent of seats in all government-funded educational institutions for OBCs. In 2011, the government conducted India's first caste census since 1931, responding to pressure from coalition and opposition parties. India's reservations discourse now hinges not on whether reservations should exist, but on who should benefit. Eventually, policymakers must confront the larger question of how and when reservations can be phased out.

Justice for State Wrongs: Compensating Victims of Custodial Violence
Every week in India, numerous citizens-predominantly the poor and marginalized-die in police custody, with over 1500 custodial deaths reported to the National Human Rights Commission from 2001-2010. Most occur within 48 hours of detention, with countless more going unreported. This strikes at democracy's foundation, shattering citizens' faith in the criminal justice system.
Before the Supreme Court developed compensatory jurisprudence, victims' families faced decade-long civil and criminal proceedings with little hope for timely justice. India's Constitution doesn't explicitly guarantee compensation for unlawful detention or custodial death, and India even filed a reservation against this right when acceding to the International Covenant on Civil and Political Rights in 1979.
The Supreme Court first recognized the right to seek compensation through habeas corpus in the "Bhagalpur blinding" cases, where police officials blinded thirty-one undertrial prisoners by pouring acid into their eyes. The Court declared it must "forge new tools and devise new remedies" for meaningful enforcement of the right to life, conceptualizing monetary compensation for constitutional violations.
In Rudul Sah v. State of Bihar, the petitioner had been detained for fourteen years after being acquitted. The Court awarded him 35,000 rupees compensation, establishing for the first time that monetary compensation could be granted for constitutional violations. The Court distinguished between "public law" remedies for fundamental rights violations and ordinary "private law" proceedings, asserting that sovereign immunity wouldn't apply in constitutional proceedings. The Court awarded 150,000 rupees to Nilabati Behera and ordered criminal proceedings against those responsible.
Despite the Supreme Court's strong condemnation of custodial violence, such cases actually increased in the 1980s. In D.K. Basu v. State of West Bengal, the Court established eleven mandatory requirements for police authorities nationwide, including regular medical examinations, the right to inform relatives about arrests, and access to lawyers during interrogation.
After the Basu judgment, courts expanded the right to claim compensation beyond custodial death cases. The Delhi High Court proved particularly progressive, removing the "sovereign immunity" defense previously enjoyed by public officials in negligence cases. Even police officers benefited from this evolving jurisprudence when a constable died due to an undefused army rocket.
The question of determining appropriate compensation for rights violations has been problematic, with courts showing inconsistency in their approach. Who Chooses the Judges? The Battle for Judicial Independence
No democracy can flourish without an independent judicial system free from fear or favor. The Indian Constitution includes several mechanisms to protect judicial independence, such as removal only through impeachment and protection of service conditions. Yet these provisions alone cannot preserve judicial integrity without addressing the powers of appointment, transfer, and promotion of judges.
While the Constitution's framers designed a system where judicial appointments would result from consultation between the President and Chief Justice, this harmony deteriorated during Indira Gandhi's government in the 1970s. The decade witnessed unprecedented conflicts between the political class and judiciary, including the shocking supersession of three senior judges when Justice A.N. Ray was appointed Chief Justice, bypassing judges who had delivered unfavorable judgments against the government.
In March 1981, Law Minister P. Shivshankar issued a circular to governors and chief ministers requesting them to obtain consent from additional judges to be appointed as permanent judges in other high courts. Though ostensibly to promote "national integration," this was actually an attempt to further undermine judicial independence by increasing political control over the judiciary.
In the First Judges Case, the Supreme Court made two revolutionary procedural changes: it expanded locus standi by allowing public-spirited citizens to file petitions for enforcement of public duties, and it rejected the government's claim of "state privilege" over official correspondence. However, on the substantive issue of judicial appointments, the Court ruled that the Chief Justice of India's opinion was not primary, effectively giving the executive final say in appointments to the higher judiciary.
After almost a decade of executive primacy in judicial appointments, the Supreme Court reconsidered its position in the Second Judges Case. The Court completely reversed its earlier stance, giving the judiciary the final word on appointments through a newly created "collegium" system. For Supreme Court and High Court appointments, the Chief Justice would decide after consulting at least two senior judges, effectively transferring primacy from the executive to the judiciary.
The Second Judges Case effectively rewrote constitutional provisions by changing "consultation" with the CJI to "concurrence." Though intended to minimize political influence, the collegium system has been criticized for its opacity by both insiders and outsiders. Even Fali Nariman, who argued for the winning side, later said he "would prefer to have lost," while Justice Verma, who authored the majority opinion, lamented its implementation.
In the Third Judges Case, a nine-judge bench unanimously endorsed the principles from the Second Judges Case, with one revision: the collegium for Supreme Court appointments would now include the CJI and four (rather than two) senior-most colleagues. The judgment merely perpetuated the collegium system without substantive changes.
Despite India's detailed constitution designed to prevent subversion of constitutional processes, the judiciary has often needed to intervene when constitutional flexibility was misused. Within two decades, we've swung from a judiciary controlled by executive will to one with theoretically unchecked power. The lack of transparency undermines the Supreme Court's legitimacy, which it must preserve given its super-administrative role in Indian democracy. While judge-controlled appointments might seem preferable to politically controlled ones, a proper balance of power remains essential.

Dignity in the Workplace: Confronting Sexual Harassment
In an emerging Indian economy with more women entering the workforce, sexual harassment has become a widespread problem across all sectors. The Supreme Court's landmark Vishaka judgment first brought this issue under sustained public scrutiny, leading to several subsequent legislative attempts to address workplace harassment.
The Vishaka case originated from the gang rape of Bhanwari Devi, a grassroots worker employed in Rajasthan's Women's Development Project. In 1992, while working to prevent child marriage, she faced harassment, threats, and social boycott from villagers. Five men ultimately raped her in her husband's presence. Despite seeking justice, she encountered numerous obstacles from police, and the trial court acquitted all accused. This injustice prompted five NGOs, under the name "Vishaka," to file a PIL in the Supreme Court seeking judicial intervention on workplace sexual harassment.
With no existing legislation on workplace sexual harassment, the Supreme Court relied on the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), which India signed in 1980, to interpret Articles 14, 15, 19, and 21 of the Constitution. The Court issued binding guidelines based on CEDAW to protect women from workplace harassment until suitable legislation could be enacted. These guidelines defined sexual harassment for the first time in India, required employers to prevent harassment and create complaint mechanisms, mandated women-led complaint committees with NGO involvement, required employee sensitization, and directed employers to support victims even when third parties were responsible.
Following Vishaka, numerous cases emerged across high courts seeking establishment of complaints committees or challenging dismissals based on committee decisions. In Apparel Export Promotion Council v. A.K. Chopra (1999), the Supreme Court expanded the definition of harassment beyond physical contact, recognizing that mental harassment could be equally damaging.
Despite Vishaka being intended as an interim measure, it took until 2013 for Parliament to pass legislation. The National Commission for Women prepared multiple drafts between 2000-2010 before the Protection of Women against Sexual Harassment at Workplace Bill was finally tabled in 2010. The bill expanded protection beyond traditional employment relationships to include clients, customers, apprentices, daily wagers, students, and hospital patients.
Despite being the only pan-India law on this specific issue for over a decade, implementation remains severely lacking. A recent survey revealed that 88% of female workers in IT and BPO companies have faced workplace harassment, with 47% not knowing where to report it, 91% fearing victimization if they reported, and 77% receiving no sensitization about harassment policies during hiring. Most employers still haven't constituted complaints committees, often doing so only when courts specifically order it in particular cases. This demonstrates how Vishaka has functioned more as a remedial than preventive measure. Only comprehensive legislation would provide systematic prevention and redressal mechanisms, ensuring workplaces become truly gender-sensitized and harassment-free.

The Right to Die with Dignity: India's Euthanasia Debate
This final landmark case examines the complex ethical and legal questions surrounding euthanasia in India. Does a terminally ill person have the right to hasten death by requesting withdrawal of treatment or lethal injection? Do relatives of patients in permanent vegetative states have the right to request removal of life support?
While India operates under laws that make attempting suicide punishable under Section 309 of the IPC, the Supreme Court has gradually evolved its position. Initially, in P. Rathinam, the Court invalidated Section 309, but later reversed this position in Gian Kaur, ruling that while the right to life doesn't include the right to die, it does encompass the "right to die with dignity"-opening a window for euthanasia in cases where natural death has already commenced.
The Aruna Shanbaug case brought these questions to the forefront. Aruna, a 25-year-old nurse at KEM Hospital, was brutally assaulted and sodomized by a hospital sweeper in November 1973, leaving her in a vegetative state for forty years. In 2009, journalist Pinki Virani petitioned the Supreme Court to allow Aruna to "die in peace and dignity," describing her deteriorated condition.
The Supreme Court established a mechanism for handling non-voluntary euthanasia cases that would operate until Parliament passed legislation. While reiterating that suicide remains illegal, the court permitted passive euthanasia (withdrawal of treatment) under certain circumstances, holding that the "right to life" includes the "right to die with dignity" but not the "right to die" per se.
The Aruna Shanbaug judgment faces criticism for tackling what is fundamentally a moral question. The distinction between passive and active euthanasia seems morally questionable-is depriving a patient of food or antibiotics truly more merciful than administering a painless death? The court's decision against euthanasia for Aruna may have been swayed by the hospital staff's dedication rather than considering her best interests and quality of life.
Post-Aruna Shanbaug, India's position on euthanasia remains inconsistent-physical suffering may justify euthanasia, but mental suffering doesn't, and attempting suicide remains punishable. Though passive euthanasia already occurs in medical practice, the judgment provides a framework for resolving disagreements through the courts. There's an urgent need for comprehensive legislation on euthanasia and suicide, considering factors like healthcare commercialization, resource scarcity, and mechanisms to prevent abuse.
A final challenging question remains about patients who regain consciousness after years in comas. How can we balance the dignity of those suffering with the remote possibility of recovery? These are questions that will continue to challenge India's legal system as medical technology advances and societal values evolve.
