The lack of extensive debate over the right to keep and bear arms suggests it wasn't controversial-unlike many other provisions that generated significant discussion. Both Federalists and Anti-federalists agreed on the importance of an armed citizenry; they simply disagreed on whether this required explicit constitutional protection.

From Founding to Modern Era: Evolving Interpretations

Early judicial interpretations of the right to keep and bear arms came almost exclusively from state courts, simply because there were no federal arms laws to challenge. State courts developed differing views on the nature and limits of the right to bear arms. In 1822, Kentucky's highest court voided the state's 1813 ban on carrying concealed weapons, ruling that any constraint on "the full and complete exercise of that right" was "forbidden by the explicit language of the constitution." Louisiana's Court of Appeals, however, upheld a concealed weapons ban, reasoning that it "interferes with no man's right to carry arms 'in full open view,'" which the court recognized as "a right guaranteed by the Constitution of the United States." When upholding a concealed carrying ban in 1840, the Alabama Supreme Court issued a warning that regulation has limits. While acknowledging the legislature's right to regulate "the manner in which arms shall be borne," the court emphasized that "a statute which, under the pretence of regulating, amounts to a destruction of the right, or which requires arms to be so borne as to render them wholly useless for the purpose of defense, would be clearly unconstitutional." Georgia enacted a statute banning all private possession of certain weapons, including pistols, on December 25, 1837. Despite Georgia having no right to bear arms in its state constitution, the Supreme Court in Nunn v. State struck down the law as violative of the Second Amendment. The court held that the right to keep and bear arms belonged to "whole people, old and young, men, women and boys," not just militia, and that this right "shall not be infringed...in the slightest degree." In the infamous Dred Scott decision, Chief Justice Taney argued that the Constitution's framers couldn't have considered free blacks as citizens because citizenship would give them rights including "the full liberty of speech" and "to keep and carry arms wherever they went." Though meant to uphold slavery, the opinion inadvertently confirmed the individual nature of the right to bear arms as understood at that time. In U.S. v. Miller (1939), concerning the National Firearms Act's regulation of sawed-off shotguns, the Supreme Court remanded for evidence on whether such weapons had "some reasonable relationship to the preservation or efficiency of a well-regulated militia." The Court noted that the militia "comprised all males physically capable of acting in concert for the common defense" who were "expected to appear bearing arms supplied by themselves and of the kind in common use at the time." After sixty years of silence on the Second Amendment, the Supreme Court ruled in District of Columbia v. Heller (2008) on a challenge to D.C.'s handgun ban. Justice Scalia wrote for the 5-4 majority, dividing the amendment into prefatory and operative clauses. He concluded that "the right of the people" refers to an individual right, not a collective one, and that "keep and bear Arms" means possessing and carrying weapons for confrontation. The Court traced the right's origins to English history and held that while the amendment's purpose was preventing elimination of the militia, Americans also valued the right for self-defense and hunting. In McDonald v. Chicago (2010), the Supreme Court ruled 5-4 that the Second Amendment applies to state governments through the Fourteenth Amendment's Due Process Clause.
