On my tenth day as U.S. Attorney, I faced an urgent situation: Hassan Nemazee, a prominent Iranian American businessman, was suspected of bank fraud and booked on a flight to Rome that evening. Unlike other cases where we had months of evidence, this investigation was just beginning. Nemazee was no ordinary target-Harvard-educated, politically connected to major Democrats and Republicans, generous philanthropist, and resident of a $28 million Park Avenue apartment.
When FBI agents intercepted Nemazee at Newark Airport, he calmly claimed it was all a misunderstanding. His lawyer not only defended him but vouched for him personally as a friend, promising Nemazee would repay the $74.9 million the next day. Remarkably, he did pay it back-but our investigation revealed he'd simply defrauded another bank of the same amount that morning using identical tactics of fakery combined with his aura of respectability.

Initial judgments by fallible humans in imperfect systems inevitably happen, but most disastrous paths are reversible if reconsidered early enough. The challenge is that opinions once formed are difficult to abandon-witnesses stick to first identifications, doctors to initial diagnoses, lawyers to their first case assessments. This psychological tendency, known as confirmation bias, becomes particularly dangerous in criminal justice where liberty and lives hang in the balance. Yet an open mind must persist beyond first judgments, especially when stakes are high.
The case of Brandon Mayfield illustrates this perfectly. After terrorists bombed Madrid trains in 2004, killing 191 people and injuring over 1,800, Spanish police recovered detonators with usable fingerprints. FBI analysts concluded that latent fingerprint 17 matched Brandon Mayfield, an American lawyer from Oregon who had converted to Islam. Three separate FBI experts confirmed this match using the standard ACE-V (Analysis, Comparison, Evaluation, and Verification) protocol, and Mayfield was placed under intensive surveillance and eventually detained as a material witness.
Despite Spanish authorities' persistent doubts about the match and complete lack of corroborating evidence (Mayfield hadn't left the United States in ten years, had no valid passport, and had no connection to Spain), the FBI remained steadfast in their conviction. Even an independent court-appointed expert confirmed the match. However, Spanish police eventually concluded the print belonged to Algerian terror suspect Ouhnane Daoud, who had a documented presence in Madrid. Only then did the FBI rescind their conclusion and issue a formal apology, ultimately paying Mayfield $2 million in compensation and implementing significant reforms in their fingerprint analysis procedures.
What went wrong? The Inspector General's comprehensive report found that FBI examiners had placed excessive reliance on perceived similarities while systematically rationalizing or dismissing differences that should have ruled out the match. The report identified multiple breakdowns in standard operating procedures, including circular reasoning and the failure to conduct truly independent verifications. While not finding overt anti-Muslim bias, the report concluded that Mayfield's religious background and legal work representing Muslims in custody disputes likely influenced examiners' "failure to sufficiently reconsider" their initial identification.

Disaster springs from the sum of many tiny errors - shortcuts taken, assumptions left unchallenged, contrary evidence minimized. Deep understanding requires active inquiry through multiple types of questions: searching questions that probe beneath surface explanations, uncomfortable questions that challenge assumptions, broad questions that establish context, narrow questions that pinpoint specifics, long-shot questions that explore unlikely scenarios, repetitive questions that test consistency, and hypothetical questions that test the boundaries of understanding.
So-called "dumb questions" are often foundational, uncovering superficial reasoning and exposing fake experts. These basic inquiries strip away jargon and complexity to reveal core truths or falsehoods. The world is populated with bullshit artists using acronyms they can't expand and concepts they don't grasp - from financial advisors throwing around terms like "derivatives" without understanding them to tech consultants misusing "blockchain" and "AI." Find the person in a new job who asks the fewest questions, and there's your problem. Their silence often masks incompetence rather than expertise.
Smart people hate looking dumb, which can be their greatest weakness. For many Assistant U.S. Attorneys, who were often top of their class and successful in private practice, not knowing something is a new and uncomfortable experience. The learning curve for prosecutors is particularly steep, with decisions affecting real people's lives and liberty. When I was a young prosecutor handling complex fraud cases, I felt perpetually perched on a ledge of ignorance, so every "stupid" question about accounting principles or trading practices moved me away from failure.
Playing dumb can have tactical value in legal proceedings. When my colleague Josh Levine was thrown into a complex securities fraud proffer session without preparation, he brilliantly told the witness: "Pretend I'm your nine-year-old nephew" to save face while learning the case. Our civil fraud enforcement program arose from simply asking why we couldn't use the Financial Institutions Reform, Recovery, and Enforcement Act (FIRREA) to sue banks for mortgage fraud - a question that led to billions in recoveries. Asking questions fosters a culture of thoughtfulness and challenge rather than rote acceptance of the status quo, leading to better practices and outcomes in the justice system.

Their impact is undeniable: Salvatore "Sammy the Bull" Gravano helped dismantle the Gambino crime family, Joseph Massino brought down the Bonannos, and corporate informants were crucial in exposing massive fraud at Enron, WorldCom, and the Galleon Group. Even Lance Armstrong, who successfully passed over 150 drug tests throughout his career, was ultimately undone by the testimony of eleven cooperating teammates who exposed the sophisticated doping scheme.
The Southern District of New York's full-confession approach to cooperating witnesses represents both continuity with traditional justice values and innovative practice in witness cooperation. By requiring complete transparency - including admission of unknown crimes - prosecutors created witnesses whose moral transformation was evident to juries. This practice skillfully balanced the transactional nature of cooperation with deeper principles of atonement and redemption, lending credibility to both the witness and the prosecution's case.
The policy yielded an unexpected benefit in exonerating the innocent. When cooperators like Gilbert Vega and Jose Rodriguez confessed to crimes for which others were wrongfully imprisoned, the system could correct its mistakes. For low-level offenses, proportionality matters deeply in maintaining public trust. My colleague Anne Milgram's approach to subway token thieves who used their mouths to extract stuck tokens-"If you're willing to do it, you should get to keep it"-reflects a sensible restraint that acknowledges both human desperation and the limits of reasonable enforcement. Such cases highlight the vital role of discretion in preventing the justice system from becoming an instrument of needless cruelty.
As U.S. Attorney, we established nuanced policies against prosecuting certain categories of cases: drug possession for personal use, recognizing addiction as a health issue rather than a criminal one; sex trafficking victims, understanding their status as exploited persons rather than willing participants; and johns in prostitution cases-including then-Governor Eliot Spitzer. While "lack of resources" is often the stated reason for such policies, these decisions reflect deeper moral and ethical judgments about proportionality, fairness, and the proper role of criminal justice in society.
Conversely, authorities sometimes hide behind "rule of law" to justify harsh actions like family separations at the border, falsely claiming their hands are tied when discretion is always available. This represents an abdication of responsibility to be ethical enforcers of the law, which inherently leaves room for interpretation and judgment. Such false claims of powerlessness often mask political choices or institutional cowardice.
When your profession involves making public accusations, you must expect and weather angry blowback from the accused and their supporters. A common tactic is questioning prosecutors' motives and alleging bias-the classic "non-denial denial" that attacks accusers rather than professing innocence. During my tenure, SDNY was variously accused of being anti-black, anti-Latino, anti-Swiss, anti-Chinese, anti-Russian, anti-Italian, anti-Indian, anti-Wall Street, anti-Democrat, anti-Republican, and even anti-poker. These accusations often came in predictable patterns: those prosecuted for financial crimes would cry anti-business bias, while those charged with public corruption would allege political motivation. After prosecuting such a diverse range of defendants across every conceivable demographic and industry, you'd think people would realize we were simply anticrime, guided by evidence and law rather than prejudice or agenda.

Justice Beyond Punishment: The Human Dimension
Criminal trials offer profound lessons in persuasion, truth, and civility-qualities increasingly absent from our public discourse. While trials aim to find truth, they operate through careful concealments: defendants' criminal histories are hidden, potential punishments undisclosed, and certain evidence suppressed. This structured environment stands in stark contrast to today's political tribalism, where people seek only comfortable viewpoints, avoid inconvenient facts, and resort to name-calling rather than reasoned debate.
Prosecutors often find determining appropriate punishment more challenging than establishing guilt. While guilt is binary-guilty or not guilty beyond reasonable doubt-sentencing involves navigating a vast continuum of options. Federal judges must impose sentences that are "sufficient but not greater than necessary," a Goldilocks standard that's inherently impossible to perfect.
Beyond the procedural aspects of justice lie larger values-mercy, forgiveness, redemption, dignity and love. This is illustrated by the remarkable story of Rais Bhuiyan, a Muslim immigrant shot in the face by white supremacist Mark Anthony Stroman during a post-9/11 hate crime spree that killed two others. Despite suffering thirty-eight pellets in his face and losing most sight in one eye, Bhuiyan forgave his attacker and campaigned for two years to spare Stroman from execution, saying simply, "He's another human being, like me."
Even more remarkably, Stroman himself was transformed by this act of compassion, writing before his execution: "I'm very grateful for Rais Bhuiyan's efforts to save my life after I tried to end his." His final words acknowledged that "hate causes a lifetime of pain." While formal justice was served when Stroman was executed in 2011, the greater lesson is how hatred was transformed through extraordinary compassion.
The law has limits. It cannot compel love or respect, cancel hate or conquer evil. The law is an amazing tool, but it takes people, "brave and strong and extraordinary people," to achieve what the law alone cannot. Justice, in its fullest sense, springs as much from the heart as from the head-a truth that resonates far beyond the courtroom doors.
