But there was a catch-the CFTC had frozen his assets, making it impossible to post bail. Nav remained locked in Wandsworth Prison, a Dickensian fortress where he spent twenty-three hours daily in a six-by-ten-foot cell, unable to sleep due to his sensitivity to light and noise. After eight weeks, he was unraveling, reading philosophy books while his lawyer Roger Burlingame desperately tried to untangle his complex financial empire. His supposed $65 million at IXE in Swiss bank Arner was inaccessible due to lock-up clauses, leaving Nav trapped in prison as his mental state deteriorated. Eventually, a psychiatrist diagnosed him with Asperger's syndrome, explaining his lifelong social difficulties and sensory sensitivities. After months of legal maneuvering, Nav was finally released on August 14 with bail reduced to 50,000, emerging with wizard-like long hair under a black hood as photographers swarmed.

The moment Nav's arrest became public, a fierce backlash erupted against the authorities. With anti-high-frequency trading sentiment at its peak following Michael Lewis's "Flash Boys," Nav's story struck many as absurd. Financial journalists ridiculed the case, while academics defended Nav. Among independent traders, Nav became a folk hero-the lone trader who beat the machines at their own game. The hashtag #freenav spread across Twitter, with one admirer comparing him to Galileo. After his release from Wandsworth Prison, Nav resumed his modest lifestyle-playing badminton with his nephews, visiting shopping centers, eating at McDonald's, and joining weekly football games with old schoolmates. Still optimistic about exoneration, Nav believed an American HFT firm had conspired with the Justice Department to report him. His hopes were crushed when the DOJ's indictment revealed damning new evidence: emails between Nav and a developer showed explicit intentions to spoof markets. "If I am short I want to spoof it down," Nav had written in 2009, along with concerns about his spoofing becoming too obvious. These emails, which Nav had apparently deleted, were devastating to his defense. The outlook grew increasingly bleak as Nav's promised funds from IXE never materialized. In October, his rival Igor Oystacher was charged with spoofing, undermining Nav's argument that he was being unfairly targeted. Then came Michael Coscia's landmark conviction as the first person criminally prosecuted for spoofing, resulting in a three-year prison sentence-an ominous precedent for Nav, who had spoofed for five years (versus Coscia's ten weeks) and earned $40 million (versus Coscia's $1.4 million). With mounting evidence against him and no money, Nav's last hope was blocking extradition. In February 2016, his barrister argued that since "spoofing" wasn't explicitly illegal in Britain, the case failed the "dual criminality" requirement for extradition. The U.S. government countered that Nav's actions violated British laws against "misleading statements" and fraud. Seven weeks after the hearing, the judge approved Nav's extradition, noting that the Flash Crash was "but a small part of the conduct alleged." On November 7, 2016, Nav flew to Chicago accompanied by FBI agents. After a sleepless night in the Metropolitan Correctional Center, he met with prosecutors and impressed them with his candor, admitting he knew his actions were illegal and intended to deceive others for profit. The CFTC separately negotiated a settlement requiring Nav to pay $38.6 million in penalties. Under normal sentencing guidelines, he faced 78-97 months in prison, but the plea deal allowed him to potentially avoid further incarceration by cooperating with government investigations from the UK.

The Aftermath: Lessons from a Market Meltdown

Nav Sarao returned to Chicago for sentencing in January 2020, over three years after pleading guilty. Garcia had returned none of the money, while various intermediaries who had introduced Nav to IXE saw their businesses collapse. At sentencing, Nav's lawyer portrayed him as an autistic savant who could barely function independently. The DOJ took the extraordinary step of recommending leniency, citing Nav's "extraordinary cooperation." Nav told the judge: "I spent 36 years trying to find happiness on a path built on a lie... Money doesn't buy you happiness, and I'm glad I know that now." Though Judge Kendall acknowledged Nav's condition, she insisted his actions warranted punishment beyond the four months already served, sentencing him to one year of house arrest at his parents' home.
