    Cette possibilité repose sur une décision juridique majeure prise en 1979, lorsque l'Allemagne a rendu le meurtre imprescriptible. En modifiant le Code pénal, le pays a supprimé tout verrou temporel pour les homicides volontaires commis avec préméditation ou cruauté. Ainsi, contrairement à l'homicide involontaire qui se prescrit après 20 ans, le meurtre permet à la justice de lancer des poursuites sans limite de temps, même contre des individus centenaires.

    Depuis la jurisprudence établie lors du procès de John Demjanjuk en 2011, la justice allemande n'a plus besoin de prouver un acte de mise à mort individuel et précis. Le simple fait d'avoir exercé comme gardien dans un camp de concentration suffit pour être poursuivi pour complicité de meurtre. On considère que l'accusé a volontairement participé au fonctionnement d'un "appareil de mort" systématique, ce qui engage sa responsabilité pénale collective.

    Le principal problème technique est la dégradation des preuves : les traces matérielles disparaissent et la mémoire des témoins centenaires devient défaillante, ce qui augmente le risque d'erreur judiciaire. Sur le plan éthique, l'état de santé des accusés, qui comparaissent parfois sur des brancards, interroge sur l'humanité de la justice. De plus, la fonction de la peine perd de son sens puisque la réinsertion est impossible et le risque de récidive est nul chez des personnes en fin de vie.

    Certains experts estiment que ces procès servent davantage de leçons d'histoire ou de compensation morale pour l'inaction passée de l'Allemagne que de véritable exercice du droit. Ils craignent que l'on transforme le tribunal en salle de classe et l'accusé en support pédagogique. En s'acharnant sur des "petits poissons" alors que les principaux responsables sont morts depuis longtemps, la justice risque de devenir une parodie d'elle-même, privilégiant l'émotion et le symbole au détriment de la rigueur juridique.
