Unlike a search engine that simply provides links, an AI chatbot can become a helpful, iterative partner in refining dangerous plans, such as researching a crime. This creates a unique ethical and legal "duty to warn" dilemma for AI companies, as they are essentially hosting private conversations where harmful intent is being confirmed and developed.

    Refusal provenance is a proposed system, such as the CAP-SRP specification, that requires companies to maintain a cryptographically signed, auditable log of what their AI systems blocked or refused to generate. Currently, the public must take a company's word that safety filters are working; refusal provenance would provide mathematical proof of how many harmful prompts were received and denied. This would shift the industry from "safety theater" to a "show me the receipts" model, allowing regulators to verify the actual effectiveness of safety tools during crises.

    The EU AI Act is set to become enforceable on August 2, 2026, marking a transition toward mandatory "operational evidence" and "runtime proofs" of safety controls. This law will require AI systems to be traceable and tamper-evident, moving away from the era where companies could simply offer verbal promises or PR-friendly updates after a failure. This deadline, combined with increasing litigation and insurers excluding AI-related exposure, is forcing companies to treat AI outputs as "product behavior" rather than protected speech.
