The 'constitutional coup' wasn't a single event but a series of small, legalistic erasures—a decree here, a dismissal there—that eventually added up to a total lockdown of the system. When a leader starts describing unions, the press, and the courts as 'obstacles' to the people's will, the architecture of autocracy is being assembled.
The term "democrature" describes a hybrid political system that maintains the outward architecture of a democracy while functioning as an autocracy. In Tunisia, President Kaïs Saïed has utilized legal scaffolding—specifically a creative interpretation of Article 80 of the 2014 Constitution—to dismantle counter-powers. By centralizing legislative and executive functions and demoting the judiciary to a mere "function" of the administration, he has created a system where all legal and political paths lead back to his authority, effectively paving over the pluralism established after the Jasmine Revolution.
The judicial system has been transformed into a tool for political repression, often referred to by observers as a "parody of justice." President Saïed dismantled the High Judicial Council to remove court neutrality and has summarily dismissed judges by decree. This has led to massive "state security" trials where political opponents, activists, and commentators face vague charges like "plotting" or "intelligence with foreign powers." High-profile cases in late 2025 saw rivals sentenced to prison terms as long as forty-five years for participating in the country's political life.
The interior and southern regions, which were the cradle of the 2011 revolution, feel abandoned because the economic promises of the uprising remain unfulfilled. In areas like Gabès and the Gafsa mining basin, residents face massive industrial pollution, lack of public investment, and high unemployment. While the central government focuses on security and "purging" political enemies, the structural issues of regional neglect have worsened, leading to a "State of Police" that manages poverty through suppression rather than solving the underlying developmental crisis.
President Saïed uses unwavering support for Palestine as a "sacred" rhetorical tool to build moral authority and national unity. However, a paradox exists because his security apparatus simultaneously cracks down on domestic activists organizing for the same cause. For example, in early 2026, organizers of a pro-Palestinian flotilla were arrested on charges of "illegal fund-collection." This suggests the regime fears any organized movement it does not directly control and seeks to monopolize the Palestinian cause to distract from domestic economic failures.
Tunisia has a long history of "state feminism" dating back to the 1956 Code of Personal Status, which granted women significant rights. While the current government still uses this progressive image for international respectability, the reality for women has become increasingly precarious. Prominent female critics and activists have faced harsh imprisonment in deplorable conditions, and rural female agricultural workers continue to suffer from extreme economic exploitation. This demonstrates that without an independent judiciary to protect them, women's rights in an autocracy are subject to the whims of the leader.
