Yet as Justice Scalia later warned, "You are kidding yourself if you think the same thing will not happen again." Today, fear and racism continue to threaten civil liberties even without the pretext of war. Despite public outrage over Trump's zero-tolerance policy separating children from parents at the southern border, the practice continued quietly, with over 1,100 children separated between June 2018 and December 2019. The lesson of Japanese internment is clear: constitutional protections are fragile, especially when fear combines with racial animus. When we allow ourselves to see fellow citizens as dangerous "others" because of their ethnicity, religion, or national origin, we betray our highest values and undermine the foundations of our democracy.

McCarthyism to Trumpism: The Return of the Paranoid Style

McCarthy seared American politics for three years, trampling the Constitution while feeding public paranoia. The fever finally broke in 1954 during televised Army hearings when, without the filter of a fawning press, Americans witnessed McCarthy's true nature. Attorney Joseph Welch's famous question-"Have you no sense of decency, sir?"-captured the moment. Public opinion shifted dramatically: McCarthy's favorable rating plummeted from 50% to 34% between January and June 1954, while his unfavorable rating rose from 29% to 45%. By December, with Senator Margaret Chase Smith leading the charge, the Senate finally found its courage and voted 65-22 to censure McCarthy. Today, McCarthyism has returned as Trumpism-pitting Americans against each other, eroding rule of law, and corroding our values. It flourishes in an unfiltered media landscape of echo chambers, bots, and "alternative facts." If left unchallenged, it will destroy our Constitution and democracy. Senator Smith's "Declaration of Conscience" remains a clarion call: "It is high time for the United States Senate and its members to do some soul-searching-for us to weigh our consciences-on the manner in which we are performing our duty to the people of America...It is high time that we remembered that we have sworn to uphold and defend the Constitution." The parallels between McCarthy and Trump are striking. Both rose to power by exploiting fear and division. Both attacked the press and judiciary when they didn't get their way. Both used accusation as evidence and treated dissent as disloyalty. Both were enabled by party leaders who knew better but remained silent for political advantage. The difference is that McCarthy's influence was eventually checked by institutional resistance-from Edward R. Murrow's courageous reporting to Margaret Chase Smith's principled stand to the Senate's eventual censure. The question for our time is whether our institutions will similarly rise to the occasion or whether they have been too weakened by decades of partisan warfare to effectively constrain authoritarian impulses. As historian Richard Hofstadter observed, the paranoid style in American politics has "greater affinity for bad causes than good." Its reemergence in the form of Trumpism represents a serious threat to American democracy-not because most Americans embrace authoritarianism, but because too many are willing to tolerate it when it serves their partisan interests.

The Surveillance State: Trading Liberty for Security

America's post-9/11 response sacrificed Fourth Amendment protections and due process for security, creating constitutional infringements that continue unabated in an endless war. By 2014, 42% of Americans approved of the government collecting their phone and internet data, while only 22% said they'd sacrifice civil liberties for safety. The surveillance apparatus began with secret presidential orders authorizing the NSA to warrantlessly intercept domestic communications. Four months after 9/11, the Defense Department established the Information Awareness Office (IAO) under retired admiral John Poindexter-previously convicted (later overturned) in the Iran-Contra affair. The IAO created Total Information Awareness (TIA), a program designed to gather and analyze unprecedented amounts of public and private data on all Americans without warrants or probable cause. When the New York Times exposed TIA in 2002, public outrage led to Congressional hearings. Though Congress supposedly terminated TIA's funding in 2003, this was a big lie-the program was secretly transferred to the "black budget" and continues today as PRISM and other surveillance systems. Despite the fig leaf prohibition against spying on Americans, Bush's Authorization to Use Military Force order effectively nullified this restriction. The result is a constitutional republic choking under a surveillance state that operates without the knowledge or consent of the people-exactly what the founders would have opposed. The NSA's wholesale surveillance of Americans exemplifies "destroying the village in order to save it"-except the village is our country and what we're destroying are fundamental constitutional protections. Congress played ordinary Americans by publicly defunding surveillance programs while quietly moving them to the black budget. Nearly two decades after 9/11, these programs operate in shadows, unchecked except in classified briefings. Americans have lost their Fourth Amendment right to be secure in "persons, houses, papers, and effects." Secret orders, power transfers, and lying to citizens demonstrate a government that doesn't respect the Constitution. Madison, Hamilton, Franklin, Washington and other founders would be appalled by this surveillance society. As the Washington Post's slogan warns: "Democracy dies in darkness." A government of, by, and for the people cannot exist when the people are kept in the dark.

Rebuilding America: From Fear to Freedom

Contrary to Pogo's famous quote, fear-not us-is the true enemy. Fear activates dormant intolerance in Americans across the political spectrum, turning us against each other and abandoning our founding motto: e pluribus unum. This fear fuels America's ascriptive tradition that violates universal rights by claiming political structures should reflect "natural inequalities." As Madison warned in Federalist 63, self-interested people have used fear throughout American history to inflame our passions. The result is stark polarization that makes compromise impossible and transforms fellow citizens into enemies-as seen in the rage against the New York Times' 1619 Project, which merely sought to explore slavery's impact on American history. When opposition becomes "the enemy within," it justifies restricting civil liberties and hollowing out our Republic. To strengthen America, we must reject fear, polarization, and hate, and instead recommit to our founding principles through ten concrete steps. The first five come from James Madison's necessary conditions for maintaining a strong Republic: 1) Establish political equality for all citizens, with equal voice and equal protection under law; 2) Withhold unnecessary opportunities that increase inequality of property; 3) Use laws to reduce extreme wealth and raise up those in poverty; 4) Ban measures that favor one interest at another's expense; and 5) Make political parties checks on each other within established norms. The remaining five steps derive from American history: 6) Stop "othering" fellow Americans through fearmongering and name-calling; 7) Confront and reconcile with our history rather than denying past mistakes; 8) Understand the real fears and challenges facing our fellow citizens; 9) Recommit to objective facts as the basis for national decision-making; and 10) Restore service to country as a requirement of citizenship. As Senator Margaret Chase Smith declared in her "Declaration of Conscience," we must think "patriotically as Americans about national security based on individual freedom" rather than as partisan political actors. Only by embracing both our ideals and our flaws can we build an America that truly lives up to its promise of liberty and justice for all. The struggle between America's democratic aspirations and authoritarian tendencies has defined our history from the beginning. Each generation must choose which tradition to embrace. By understanding our past failures, we can avoid repeating them. By acknowledging our capacity for authoritarianism, we can guard against it. And by recommitting to our highest values, we can create an America worthy of its founding promise.
